Principles

In order to operate effectively and fulfil its legal obligations, TecSell Recruitment Limited needs to collect, maintain and use certain personal information about current, past and prospective candidates and other individuals with whom it has dealings. All such personal information, whether held on computer, paper or other media, will be obtained, handled, processed, transported and stored lawfully and correctly, in accordance with the safeguards contained in the Data Protection Act 1998 (DPA).

TecSell Recruitment Limited is committed to the eight principles of data protection as detailed in the DPA. These principles require that personal information must:

  • be fairly and lawfully processed and not processed unless specific conditions are met;
  • be obtained for one or more specified, lawful purposes and not processed in any manner incompatible with those purposes;
  • be adequate, relevant and not excessive for those purposes;
  • be accurate and, where necessary, kept up to date;
  • not be kept for longer than is necessary;
  • be processed in accordance with the data subject’s rights under the DPA;
  • be kept secure form unauthorised or unlawful processing and protected against accidental loss, destruction or damage; and
  • not be transferred to countries outside the European Economic Area (EEA) unless the country or territory ensures adequate protection for the rights and freedoms of the data subjects.

Compliance

In order to comply with the data protection principles, TecSell Recruitment Limited will:

  • observe fully all conditions regarding the fair collection and use of personal information;
  • meet its legal obligations to specify the purpose for which information is used;
  • collect and process appropriate personal information only to the extent that it is needed to fulfil operational needs or to comply with legal obligations;
  • ensure the quality of the personal information used;
  • apply strict checks to determine the length of time personal information is held;
  • ensure that individuals about whom information is held are able to exercise their rights under the DPA, including the right to be informed that processing is taking place, the right of access to their own personal information, the right to prevent processing in certain circumstances and the right to correct, rectify, block or erase incorrect information;
  • take appropriate technical and organisational security measures to safeguard personal information; and
  • ensure that personal information is not transferred outside the EEA without suitable safeguards.

Responsibilities

  • Overall responsibility for ensuring that the Company complies with its data protection obligations rests with the company directors.
  • It is the responsibility of all candidates to ensure that personal information provided to TecSell Recruitment, for example current address, is accurate and up to date. To this end employees are required to inform TecSell Recruitment immediately when changes occur.
  • Employees whose role involves the collection, maintenance and processing of personal information regarding candidates or any other individuals, or companies with whom TecSell Recruitment has dealings are responsible for following TecSell Recruitment’s rules on good data protection practice as notified from time to time by their Manager.

Information about candidates.

TecSell Recruitment Limited holds the following personal information in relation to its candidates:

Name, Address, Contact information, Salary expectations, Educational history, Working history and any other information deemed necessary to secure a position or job opportunity

This information is used for assessing and obtaining opportunities in line with the candidate’s requirements.

We also hold all or some of the following sensitive personal information about candidates:

Bank Details, NI Number, Date of Birth and personal tax references and any other information required to meet all salary, invoice and tax payments lawfully.

This information is used for the purpose of paying candidates or contractors and may from time to time be collected on behalf of an employer if authorised by the candidate to do so.

Access to information

Anyone who is the subject of personal information held by TecSell Recruitment has the right to make a subject access request. Candidates who wish to exercise this right should write to a Director of TecSell Recruitment. If, as the result of a subject access request, any personal information is found to be incorrect it will be amended. TecSell Recruitment will deal promptly with subject access requests and will normally respond within 40 days. If there is a reason for delay, the person making the request will be informed accordingly.

Candidate Agreement

By submitting your details to TecSell Recruitment Limited you are confirming that:

1) All the information I have given is correct.

2) I am aware that personal data relating to myself (including, where relevant, sensitive personal data*), whether obtained from myself or from any other source, will be retained by members of TecSell Recruitment for the purposes of providing me with temporary work and/or employment opportunities and/or training.

3) I acknowledge that this may require my personal data to be forwarded to other persons for the purpose of conducting checks and references, to find me work and for other lawful purposes related to TecSell Recruitment’ recruitment services. TecSell Recruitment will request references from my work and/or personal referees and in certain circumstances, with my consent, will obtain a credit reference from a credit agency and/or a Disclosure from the Criminal Records Bureau.

TecSell Recruitment will not request a reference from my current employer without my consent.

4) I acknowledge that without my consent to process my personal data in this manner TecSell Recruitment are unable to assist me in my search for work.

5) I understand and agree that TecSell Recruitment may pass information contained within and resulting from my application (including references received and all forms completed by me) to any third party organization affiliated to TecSell Recruitment or for any external audit purposes. This information may be used by said parties for the purposes of processing my application, ongoing personnel administration (where applicable), additional screening required by the above and other lawful purposes related to my temporary or permanent position. I hereby consent to TecSell Recruitment passing such information and a copy of my application and completed recruitment forms to third parties and for this information to be used and retained by TecSell Recruitment for the above purposes.

I hereby confirm that by submitting my personal data to TecSell Recruitment I am authorising that it may be held and disclosed by TecSell Recruitment for the purposes and in the manner set out above.
